Workplace Accidents: Employee Rights and Compensation Procedures
If you were injured in a workplace accident, you have a range of legal rights and compensation channels available to you. This guide outlines the key steps and procedures for injured workers in Israel.
What Is a Workplace Accident?
A workplace accident is any injury that occurs during work activity or on the way to or from work. The injury must have a direct connection to the employment relationship to qualify for benefits and compensation.
National Insurance Institute (Bituach Leumi) Claims
The first step for any injured worker is filing a claim with the National Insurance Institute. A recognized workplace accident entitles the worker to: sick pay for the period of incapacity, disability benefits if a permanent disability is determined, and rehabilitation services.
Tort Claims Against the Employer
Beyond National Insurance benefits, an injured employee may also file a civil tort claim against the employer if the accident resulted from the employer’s negligence. This can result in compensation for pain and suffering, lost income, and future medical expenses — damages not covered by National Insurance.
Third-Party Claims
If the accident was caused by a third party (for example, a defective piece of equipment manufactured by another company), the worker may also file a claim against that third party directly.
Steps to Take After a Workplace Accident
Document the accident in writing immediately. Seek medical treatment and keep all records. Report the accident to the employer and the National Insurance Institute within the required time limits. Consult a lawyer specializing in workplace accidents before any settlement is reached.
