Road Accident Involving a Parked Vehicle? The 2025 Supreme Court Ruling Every Victim Must Know
Can a parked vehicle be legally “involved” in a road accident even when it was stationary at the time of the collision? In a landmark 2025 ruling, the Israeli Supreme Court answered this question definitively: yes — and that answer has far-reaching implications for accident victims and their right to compensation.
The Facts of the Case
The case concerned a vehicle that was parked in a prohibited zone. Another vehicle swerved to avoid it and caused an accident. The parked vehicle’s insurer denied liability, arguing that a stationary car cannot be considered “involved” in an accident under the Road Accident Victims Compensation Law. The Supreme Court rejected this argument.
The Supreme Court’s Key Ruling
The Court held that a vehicle parked in a prohibited location constitutes a road hazard. When that hazard directly causes or materially contributes to an accident, the vehicle is legally “involved” in the accident — and its compulsory insurer bears full liability to compensate the victims. The fact that the vehicle was stationary does not, by itself, remove it from the scope of the law.
What Does “Involvement” Mean in Israeli Road Accident Law?
Under the Road Accident Victims Compensation Law (1975), an accident victim is entitled to compensation from the insurer of any vehicle “involved” in the accident, regardless of fault. The Supreme Court’s 2025 ruling expands the meaning of involvement to cover situations where a parked vehicle’s presence — particularly in a prohibited or dangerous location — was a material cause of the accident chain.
The Karnit Fund and Subrogation Claims
In cases where the parked vehicle was uninsured or could not be identified, the Karnit Fund (Israel’s Motor Accident Victims Fund) may compensate the victim. The Fund may then pursue a subrogation claim against the responsible party. The Supreme Court’s ruling clarifies the boundaries of this mechanism and strengthens victims’ access to compensation from all available sources.
Practical Steps for Accident Victims
If you were injured in an accident involving a parked vehicle: document the scene thoroughly with photographs; obtain the details of all vehicles present; file a police report; seek medical attention immediately; and contact a road accident lawyer promptly. Time limits under Israeli law are strict — delay can forfeit your claim.
Why This Ruling Matters
This ruling protects victims who were previously denied compensation on the technical ground that the vehicle causing the hazard was parked. It confirms that road safety obligations attach to vehicle owners even when their vehicle is stationary, and it ensures that insurance coverage functions as a genuine safety net for all road accident victims.
